You represent that you have the necessary rights to submit the content.

You may not submit content that:

  • Infringes another person's intellectual property rights

  • Contains unlawful material

  • Contains malicious software

  • Reveals another person's private information without authorization

  • Impersonates another person

  • Is fraudulent or intentionally misleading

  • Violates applicable law

We may remove User Content that violates these Terms or applicable law.

Nothing in these Terms prohibits or restricts you from providing an honest review, assessment, or opinion regarding our products or Services.

23. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Sim Capital LLC, React Skin, and their respective owners, members, managers, officers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to your use of the Services.

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, corporate restructuring, sale of assets, financing transaction, or transfer of the React Skin business, subject to applicable law.

36. Entire Agreement

These Terms, together with policies incorporated by reference, constitute the agreement between you and Sim Capital LLC regarding your use of the Services and purchases from React Skin, except where additional written terms expressly apply.

37. Changes to These Terms

We may update these Terms from time to time for operational, business, legal, regulatory, security, or other reasons.

The updated Terms will be posted on our website with a revised “Last Updated” date.

Where required by applicable law, we will provide additional notice of material changes.
